Has The Irreverent Ke$ha Ripped Off The Residents While On Tour?

Ke$ha, pop's bad ass princess, toured with Pitbull this summer and is soon to start her own headlining tour in August.

On her tour she brought along her usual bag of tricks: glitter, lasers, dancing penises, and more. But in a recent spat of tour drama, an art rock band from Louisiana, the Residents, are claiming Ke$ha ripped them off for the use oversized eyeball masks worn by her tuxedo donned back-up dancers. The bizarre stage presence is not unusual for this pop singer, who has drank fake blood out of a realistic looking heart during her performances of "Cannibal".

The Residents-inspired costumes seem to have caused an uproar with the band. Kesha, an apparent fan of the band, once wore a Residents shirt during an interview with MTV, according to Stereogum. She has yet to comment on this matter.

Here are the Residents dressed strikingly similar to Ke$ha's back-up dancers:

Don Hardy, a documentarian who is currently working with the Residents, told Yahoo Music that Kesha is:

...interfering with their intellectual property. Her people definitely didn’t call in to say, ‘Hey, can we use this?’ They’re debating what to do. One potential way to deal with it is to ask for a cease-and-desist and have attorneys sort it out. I think they’d rather see a different outcome, though. When you’re a smaller group, what do you do? If you file suit, people say, ‘Oh, it’s the small guys trying to get in on something big.’ It’s a no-win situation.

Hardy went on to say that if Kesha at least acknowledged the situation by telling her fans that the costumes were an homage to the Residents, her fans would check out the art rock band, giving them credit and recognition.
